Soluthium General Privacy Statement

Soluthium.com is highly sensitive to the privacy interests of consumers and visitors and believes that the protection of those interests is a important responsibility. In acknowledgment this, Soluthium has adopted the following Privacy Policy, applicable to information about consumers and visitors that it acquires in the course of its business:

  1. Acquisition of Information. We do not acquire any more information about consumers than is required by law or is otherwise necessary to provide a high level of service efficiently and securely.
  2. Our Employees and Privacy. We train all of our employees about the importance of privacy. We give access to information about consumers only to those employees who require it to perform their jobs.
  3. Security Measures. We make access to privacy-sensitive information subject to rigorous procedural and technological controls, consistent with legal requirements and the demands of customer service.
  4. Disclosure to Third Parties. We will provide individually-identifiable information about consumers to third parties only if we are compelled to do so by order of a duly-empowered governmental authority, we have the express permission of the consumer, or it is necessary to process transactions and provide our services.
  5. Privacy and Our Business Partners. When we make our technology or services available to business partners, we will not share with them any more consumer information than is necessary, and we will make every reasonable effort to assure, by contract or otherwise, that they use our technology and services in a manner that is consistent with this Privacy Policy.

  1. SoluThium Cloud Data Privacy
    1. Collection and Use of Data
      1. The Products incorporate connectivity features (including 4G, GPS, Bluetooth, CANBus, RS485, and the SoluThium mobile application) that collect, transmit, and store data relating to battery performance, location, usage patterns, cycle counts, temperature, charge/discharge history, error codes, and other diagnostic information (collectively, “Battery Data”).
      2. The Manufacturer shall have the right to access, collect, store, analyze, and use Battery Data for the following purposes:
        • Product monitoring and diagnostics
        • Warranty verification and claims processing
        • Product research, development, and improvement
        • Quality assurance and safety monitoring
        • Aggregate anonymized analytics
    2. End-User Consent
      1. The Distributor shall ensure that each end-user is informed, before or at the time of sale, that:
      2. Battery Data may be transmitted to and accessible by the Manufacturer.
      3. Such data collection is necessary for full product functionality, warranty support, and ongoing improvements; and
      4. End-users consent to the Manufacturer’s collection and use of Battery Data as described herein by purchasing and activating the Product.
      5. The Distributor shall provide end-users with the Manufacturer’s current Privacy Notice (available at www.SoluThium.com/privacy or via the mobile application) and shall not make any representations contradicting such notice.
    3. Compliance with Privacy Laws
      1. Each party shall comply with all applicable data protection and privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), where applicable, and any other federal, state, or international privacy regulations.
      2. The Manufacturer shall implement and maintain reasonable technical and organizational measures to protect Battery Data against unauthorized access, loss, or disclosure.
    4. Distributor Obligations
      1. The Distributor shall:
        1. Not attempt to access, intercept, or store Battery Data beyond what is necessary for customer support or warranty assistance.
        2. Promptly forward any end-user privacy inquiries or requests (e.g., access, deletion, or opt-out requests) to the Manufacturer.
        3. Not disclose Battery Data to third parties without the Manufacturer’s prior written consent.
    5. Data Processing
      1. To the extent the Distributor processes any personal data (as defined under applicable privacy laws) on behalf of the Manufacturer or end-users, the Distributor shall act solely as a service provider or processor and shall process such data only in accordance with the Manufacturer’s documented instructions and applicable law.
    6. Breach Notification
      1. Each party shall promptly notify the other in writing of any known or suspected breach of security involving Battery Data or personal information, and shall cooperate in investigating and mitigating such breach.

    1. By activating the SoluThium™ Cloud Service and registering as a user, you provide express consent for the collection and processing of your geolocation data and usage habits to enable advanced system optimization. You acknowledge that our ecosystem gathers operational telemetry—including voltage, thermal metrics, etc. —which are analyzed via Big Data Analytics (BDA) and Machine Learning to provide predictive maintenance, Over-the-Air (OTA) firmware updates, and fail-safe protections. While SoluThium™ utilizes these insights strictly to enhance battery longevity and safety, we reserve the right to disclose collected data, including GPS and usage history, to law enforcement or regulatory authorities when required by a valid legal process—such as a subpoena, court order, or search warrant. Furthermore, SoluThium™ is not responsible for the data practices of third-party platforms integrated via our APIs. Users may opt out of cloud connectivity; however, this will disable remote monitoring and automated safety diagnostic services.
    2. Confidential Information
      1. “Confidential Information” includes proprietary data, trade secrets, product specifications, pricing, and business strategies disclosed by one party to the other. For clarity, Battery Data that has been anonymized and aggregated shall not constitute Confidential Information.
